So definitely Fallax. And small ones, too. Although of course "as a Formica" is a very vague concept, formics can be twice as different from each other, and even within the species. But in any case, herculeanus is noticeably larger..

Genus Formica, subgenus Serviformica. Only the hairs on the chest and head are visible, but they are not visible. A purely external data is most similar to Formica cunicularia. But you can't tell for sure from these photos.
